1. Agreement to Terms

By downloading, installing, or using PushClock ("the App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

PushClock is a mobile application that functions as an aggressive alarm clock. It requires users to complete specific physical or mental missions (e.g., pushups, solving math problems, or taking pictures of objects) to dismiss alarms. The App operates entirely on your device and does not upload your camera feed to external servers.

3. Subscription Service

PushClock offers auto-renewable subscriptions to access premium features:

• Monthly Subscription: Provides unlimited access to all features. Automatically renews every month unless cancelled.
• Yearly Subscription: Provides unlimited access to all features. Automatically renews every year unless cancelled.

Subscription Details:

• Subscriptions are managed through your Apple ID account
• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase

4. User Responsibilities & Disclaimer

Important: You are solely responsible for ensuring you wake up on time. While PushClock is designed to be highly effective, we cannot guarantee that the alarm will trigger under all circumstances.

• You must ensure your device has sufficient battery life.
• You must grant the necessary system permissions (Notifications, Camera, etc.) for the app to function properly.
• We are not responsible for any missed alarms, lost wages, missed appointments, or any other consequences resulting from the app failing to ring or failing to detect your mission completion.
• Engage in physical missions (like pushups or squats) at your own risk. Consult a physician if you have health concerns.

5. Privacy

Your use of the App is also governed by our Privacy Policy. Please review our Privacy Policy, which explains how we prioritize on-device processing to keep your data secure.

6. Intellectual Property

The App, including all content, features, and functionality, is owned by PushClock and is protected by international copyright, trademark, and other intellectual property laws.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PUSHCLOCK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE APP.
